THE IMPLEMENTATION OF LAND REGISTRATION ON THE USE OF RESERVED LAND BY THE TRANSMIGRATION COMMUNITY IN DHARMASRAYA DISTRICT

Abstract

The land rights given to transmigrants originate from state land where this state land also arises from the existence of tenure rights. Control rights are converted into management rights by the Ministry of Manpower and Transmigration and these management rights are given ownership rights to transmigrants. Legal certainty regarding the majority of residents who do not have evidence is also sought through physical evidence of control, this is land that has been controlled continuously for a period of 20 (twenty) years. Based on this, the author formulates the problem, namely, firstly, why is there transmigration restan (remaining) land, secondly, how can the transmigration community control transmigration restan (remaining) land, third, what is the land registration process regarding control of transmigration community restan (remaining) land in Sitiung District, Dharmasraya Regency? . This research method is empirical juridical legal research, namely legal research by obtaining data directly from respondents. The results of the research show that the existence of restan (residual) land arises based on the advantages of the government program for transmigration communities. At that time, the Restan (remaining) land was in the form of swamp, forest or bushes so it was not suitable for land to be distributed to the community. The process of registering restan land at the Dharmasraya district land office means that there are several document requirements that must be completed by the transmigration community who owns the restan (residual) land if they want to register it, namely: a statement of control over the R (restan) land, a letter of application for the issuance of a statement of control over land R (restan) by the applicant, certificate of control of land R (restan) by the guardian of nigari, letter of statement of absolute responsibility by the applicant, letter of application for the issuance of recommendations by the Wali Nagari to the sub-district head, letter of application for recommendation by the sub-district head.
